General

  1. This page (alongside our policies) apply to anyone using any pages of the Stag Direct website ("website")(including all associated domains) as well as our online shop. By using and continuing to use the website you are agreeing to these terms and conditions. Stag Direct retain the right to change the terms and conditions at any time without prior notice.
  2. The website and all associated domains are owned by Stag Chemist Birmingham Limited whose registered company address is 230 Stoney Lane, Balsall Heath, Birmingham, B12 8AN.
  3. The website is operated from the GPhC registered pharmacy trading address at 10A Haden Street, Balsall Heath, Birmingham, B12 9BH as Stag Direct.
  4. These terms and conditions apply for as long as Stag Direct is operating the website.
  5. Our superintendent pharmacist is Abid Hussain (GPhC registration: 2050590)
  6. Unless otherwise stated, all nominated patients' prescriptions are processed by Stag Direct or from one of our branches as listed on the Branches webpage.
  7. The contents of the website are specifically for UK residents. The law regarding the operation of the website is governed by English law and any transaction via our online shop or otherwise is deemed to have taken place in England. The website is therefore subject to the jurisdiction of English courts.
  8. The online shop function is provided by Ionos. Anyone wishing to make a purchase must submit their details with the website.
  9. To order repeat NHS prescriptions you are confirming you are at least 16 years of age.
  10. To purchase items through our online shop you are confirming you are at least 18 years of age.
  11. Proof of age and/or ID can be requested by Stag Direct at any time and Stag Direct reserve the right to refuse and/or cancel a transaction if proof is not satisfactory to the Stag Direct operatives (including all staff and pharmacists).
  12. We may provide links from the website to websites that are owned and controlled by third parties. These links are provided only for your convenience and we have no control over and will have no liability in respect of those websites.
  13. You are responsible for ensuring that all persons who access the site through your internet connection are aware of these terms and conditions and that they comply with them.
  14. We may amend these terms and conditions from time to time.
  15. Every time you wish to use the site, please check these terms and conditions to ensure you understand the terms and conditions that apply at that time.
     

Contacting us 

  1. If for any reason you need to contact us, the easiest way is by phone or email as provided on the Contact Us webpage and on the website footer. The operatives may ask for personal details (such as, but not limited to: name, date of birth, address, post code, NHS number) in order to resolve any queries.
  2. By accepting these terms and conditions, you are communicating with us electronically and, in doing so, you are deemed to consent to receiving communications from us electronically. Electronic communications include, but are not limited, to emails, notifications, alerts, prompts, disclosures and information fields or other information provided via the site. You agree that any electronic communication made to you by us is sufficient to satisfy any legal requirement that such communication be made to you in writing.

 

Your information

  1. We use your information in line with the Data Protection Act and GDPR guidelines.
  2. Where you provide us with information, we will only use it to provide our services to you.
  3. Your data and information will not be sold to other parties unless it is anonymised and used to enhance our service and/or improve patient safety.
  4. Your data and information will not be shared with other parties unless it is part of our normal operation in providing our services. The parties we share your information with are: NHSBSA for prescription and service payment verification, your GP surgery to update your medical history, PharmOutcomes as our service provider platform, GPhC for any complaints raised in regards to our practice.
  5. Any information shared with the parties mentioned in part 4 of Your information, will be shared in a secure manner and where appropriate annonymised, to protect your data.
  6. By using and/or consenting to any of our services you agree for us to share your data in line with the terms in Your information.

 

Use of our services

  1. By using any of our services, including but not limited to: Electronic Prescription Service (EPS), Nomination, Pharmacy First, Flu Jabs, MDS, you are confirming the following:
    • Any details requested by Stag Direct and provided by you is complete and accurate.
    • You are aged at least 18 years of age and have comepetency to provide consent to services.
    • Any communication methods needed to provide a service are consented to.
  2. You have the right to revoke consent from any of our services at any time if clinically appropriate. Where consent is revoked part-way through a service, we and our team (including but not limited to staff and pharmacists) can not be held responsible for cause of harm and/or damage to property and/or person which our team determine would not have occurred if consent had not been revoked.
  3. Where consent for any part of a service (including but not limited to: data sharing, record keeping) is not provided, our team (including but not limited to staff and pharmacists) retain the right to refuse the service all together.
  4. Although we make reasonable efforts to update the content of our website, including descriptions of products or services and our shop, we make no representations, warranties or guarantees, whether express or implied, that such content is accurate, complete or up to date.

 

Security 

  1. If you choose, or you are provided with, a user identification code, username, password or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
  2. We have the right to disable any user identification code, username or password, whether chosen by you or allocated by us, at any time, if in our reasonable opinion you have failed to comply with any of our terms and conditions.
  3. If you know or suspect that anyone other than you knows your user identification code, username or password, you must promptly notify us at stag.direct@gmail.com

 

Your conduct 

  1. You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way.
  2. You understand that you, and not Stag Direct or Stag Chemist Birmingham Limited are responsible for all electronic communications and content sent from your computer to us and you must use the website for lawful purposes only.
  3. You must not use the website or make contact with any of our branches and/or staff operatives for any of the following:
    • for fraudulent purposes, or in connection with a criminal offence or other unlawful activity
    • to send, use or reuse any material that is illegal, offensive, abusive, indecent, defamatory, obscene or menacing; or in breach of copyright, trademark, confidence, privacy or any other right; or is otherwise injurious to third parties; or objectionable; or which consists of or contains software viruses, political campaigning, commercial solicitation, chain letters, mass mailings or any "spam"
    • to cause annoyance, inconvenience or needless anxiety
    • communication using foul language, threatening, inappropriate, abusive, offensive behaviour or remarks
    • engaging in any behaviour believed to be time-wasting
    • using our services excessively or inappropriately, as determined in our reasonable opinion
  4. We reserve the right to cancel any service provision or communication, if your conduct as stated in part 3 of Your Conduct of our terms and conditions is deemed to be unreasonable by us or any of our operatives with immediate effect.
  5. We accept no liability for any loss or damage that is caused by material that is uploaded to our site by you or any other user of the site, or that is taken from another website and published on the site. We may remove or edit content without notice if we consider that it may cause damage to or affect the rights of third parties, is not correct, or if it is defamatory or indecent.
  6. We reserve the right to remove or reject content or corrupted files, which we suspect pose a risk to the site. We accept no responsibility for user-uploaded content which violates copyright law, and reserve the right to remove this without notice.

 

The website

  1. The website platform is made available to you free of charge
  2. We do not guarantee that the site or any material on it will always be available or be uninterrupted. We may suspend, withdraw or restrict the availability of all or any part of the site for business and operational reasons. We will try to give you reasonable notice of any suspension or withdrawal.
  3. You may link to our website, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.
  4. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.
  5. You must not establish a link to our website in any website that is not owned by you.
  6. We reserve the right to withdraw linking permission without notice.
  7. The images we use on our website and shop are for illustrative purposes only.
  8. Products may vary from the images on the website and we accept no responsibility for any reliance that you may place on the accuracy of the images used on the website.
  9. The packaging for products may vary from time to time to that shown on images on the site.
  10. All products shown on the website remain at all times subject to availability. If the product you have ordered is unavailable, we will notify you as soon as possible and we will refund your payment promptly.

 

Dispatch and delivery

  1. By using our prescription processing and shop services, you agree for us to process your information for the purpose of arranging a delivery. This may include but is not limited to, sharing some or all of your contact details with our chosen couriers.
  2. For prescriptions (all types including but not limited to: repeat, acute, electronic, paper, NHS and/or private), unless otherwise stated, delivery will be made to the address which is on your prescription.
  3. You can request a change to your delivery address for prescriptions, whether as a one-off or for regular deliveries by contacting our team. You are responsible for informing us of a different address in a timely manner, namely before your prescription is dispatched. Once dispatched, we cannot guarantee we will be able to change the delivery destination.
  4. For any tracking information provided, this will be the responsibility of the chosen courier and we cannot accept responsibility for it's accuracy.

 

Prescriptions and nomination

  1. By setting your nomination to Stag Direct you consent to us processing and delivering your prescription items (in line with Dispatch and delivery terms).
  2. You have the right to remove or change your nominated pharmacy at any time. This can be done by contacting us or your GP practice.
  3. Once nominated, your NHS electronic prescriptions will be sent securely to our pharmacy via the NHS Spine.
  4. If you wish to have a prescription returned to the NHS Spine, you are responsible for informing our team before we process it.
  5. Once we have processed your prescription, we may not be able to return the prescription back to the NHS Spine if you wish to have your prescription processed at another pharmacy.

 

Events outside our control

  1. We will not be responsible for any delay or failure to comply with our obligations under these terms and conditions if the delay or failure arises from any cause which is beyond our reasonable control. This condition does not affect your statutory rights.

 

Price of products and services

  1. Prices of products and/or services displayed on our website and shop are subject to change. Where possible, we will endevour to treat quoted prices as final prices for the customer.
  2. Prices for products and/or services include VAT (where applicable) at the applicable current rate chargeable in the UK.
  3. Unless otherwise exempt, delivery and/or collection costs will be paid by the customer before completing the order and delivery and/or collection will be treated as a separate product/service to the material item.
  4. Where there is a discrepancy with the prices of a placed order, all due efforts will be made to contact you to clarify and amend the pricing or to cancel the order. We will not proceed with the order without receipt of instructions by the customer.

 

Payment

  1. Payment for all products and services charges must be made in full at the time of placing the order.
  2. Payment can be made by debit or credit card or relevant payment gateway (method).
  3. You are responsible for providing valid payment method details. We reserve the right not to provide products or services to you if your payment details have expired or are invalid. In such cases, we will attempt to contact you to enable you to provide updated information.
  4. To ensure that your debit or credit card is not being used without your consent, we will validate name, address and other personal information supplied by you during the order process against appropriate third party databases. By submitting payment method details, you consent to such checks being made. In performing these checks, personal information provided by you may be disclosed to a registered credit reference agency, which may keep a record of that information. This is done only to confirm your identity. A credit check is not performed and your credit rating will not be affected. All information provided by you will be treated securely and strictly in accordance with current and applicable data protection legislation.
  5.  In providing payment method details, you confirm that you are authorised to use the card/method and authorise us or our payment service provider to take payment in full for the items in your order, postage and packing charges and any other charges that become due to us under these terms and conditions. 

 

Refunds

  1. The Consumer Rights Act 2015 allows consumers to claim a refund on faulty goods within 30 (thirty) days of receipt. In some cases, we may offer to replace a product free of charge: if the first replacement item we supply also turns out to be faulty, you can claim a refund at this point. If you consider that any of the products you have ordered are damaged or faulty, please contact us.
  2. Please note: Any product classified or deemed to be medication, including those prescribed via NHS or private prescriber or via our shop cannot be returned and/or refunded.
  3. Any refund of postal charges will be at our discretion and may not be made.
  4. It is your responsibility to inform us of any faulty or damaged goods within the timeframe as specified by the Consumer Rights Act 2015, before any refund or replacement can be initiated.
  5. Your refund will be processed once we receive the returned product. Refunds, if applicable, will only be made using the payment method and/or to the card originally used for payment and will take 5 (five) to 7 (seven) working days to be credited to your account, depending on your card provider.
  6. Unfortunately, you cannot return Prescribed Medicines or any other Prescription Only Medicine (POM), or anything that has a hygiene seal that has been broken. You have the right to reasonably inspect your items as you would in a shop, but you cannot return items that you have used, unless you are returning them because they are damaged or faulty.
  7. You can return a product within 30 days of order, and request a refund (minus delivery costs) as long as the product is in it's original packaging, unused, unopened and in a resellable condition.
  8. You cannot return and/or request a refund for products/services purchased elswhere, including other websites and branches. Where our team cannot verify where the product you wish to return has been purchased from, we reserve the right to refuse to process the return and/or refund.

Our liability to you

  1.  We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
  2. We will not be liable, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, for:
    • loss or damage caused by you providing inaccurate or incomplete information
    • loss of your emotional well-being including, but not limited to, any embarrassment caused
    • loss of income or anticipated profits
    • loss of opportunity
    • loss of goodwill or injury to reputation
    • losses suffered by third parties
    • any indirect, consequential, special or exemplary damages arising from the use of the service regardless of the form of action
  3. We accept full clinical responsibility to all of our patients to the fullest extent that the law requires for our performance of or services. However, we will not be liable for any loss or damage (in contract, negligence or otherwise) where:
    • there is no breach of a legal duty of care owed to you by us
    • loss or damage is caused by you providing inaccurate or incomplete information
    • the loss or damage is not a reasonably foreseeable result of any such breach
    • any loss or damage or increased risk of loss or damage results from a breach by you of these terms and conditions
  4. Our total liability to you whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising under or in connection with the provision of our products and/or services shall be limited to the amount paid by you in respect of such product and/or service.
  5. The website is not designed and is unsuitable for the treatment and/or management of a medical emergency or any acute condition or condition that would otherwise warrant analysis, diagnosis or treatment in person or where analysis, diagnosis or treatment would be required on an urgent basis.
  6. We will take all appropriate technical and organisational measures against unauthorised or unlawful processing of your personal data and against accidental loss or destruction of, or damage to, personal data but subject to that and our obligations under law as a data controller, we shall not be responsible for any data loss or unauthorised access by other persons, whether a result of unauthorised access, misaddress, technical failure, technical interference, negligence or otherwise.
  7. We disclaim all warranties, express or implied (to the extent permitted by law) including, but not limited to, implied warranties of satisfactory quality and fitness for a particular purpose. We do not warrant that the site or any notifications sent by us to you will be free of viruses or other harmful components.
  8. We do not accept any liability or responsibility for the actions or omissions of any third party.
  9. We only supply products and services for your own personal, domestic and private use. You agree not to supply the products to any other person or to use the products and/or services for any commercial, business or re-sale purpose, and we shall have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity if you use such products and/or services otherwise than in accordance with these terms.
  10. We are not liable for loss or damage, which arises from your failure to inform your regular doctor or other healthcare professional about any products and/or services which you order from the website.
  11. We are not liable for any loss or damage, which results from your failure to follow advice given on the website and/or from our team.
  12. You accept that the advice provided through the website does not replace the advice provided to you by your regular doctor and that you should consult with your regular doctor and other healthcare professionals on the products and/or services supplied through the website.
  13. Professional codes of conduct and legal restrictions may limit the number of any items we are permitted to supply to you and, as such, we have no obligation to supply quantities exceeding the relevant permitted maximum and will charge only for those that we do supply. 
  14. Nothing in these Terms affects your statutory rights.
